Monroe Operations LLC d/b/a Newport Healthcare (“Newport,” the “Company,” “we,” “our”, or “us”), is committed to maintaining the privacy and security of your Personal Information in accordance with all applicable laws. We collect and process your Personal Information fairly and lawfully and in order to carry out our lawful business activities.

Our Privacy Policy explains the Company’s privacy practices with respect to Personal Information collected through its website, newportinstitute.com and dependent pages (together with its features and services, the “Site”), and Personal Information we may collect from you in your other interactions with us (e.g., when you apply for employment or attend one of our virtual or in person continuing education courses, events or conferences). In addition to this Privacy Policy, you may receive additional notice at the time of attending a continuing education course, or other events or conferences.

If you are a patient, the Company’s HIPAA Notice of Privacy Practices describes how the Company uses and discloses Protected Health Information (“PHI”) in its capacity as a healthcare provider and in relation to its healthcare services. We adhere to the privacy protections under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) for your PHI. This Privacy Policy does not apply to Protected Health Information as defined under HIPAA.

How We Collect Personal Information

We collect the Personal Information you directly provide to us, Personal Information collected when you use our Site, and Personal Information received from third parties. With your approval we may also use your information and story in our marketing materials.

Personal Information we collect when you use our Site

We collect certain Personal Information from you when you use of our Site, such as device/browser and usage data. We collect many different types of information from other technologies (in addition to cookies) to improve the quality of our Site and provide you with advertising that may be of interest to you. These technologies include web beacons, pixels and scripts.

Web beacons are pieces of code embedded in a website or e-mail to monitor your activity on the website or your opening of the e-mail, and which can pass along information such as the IP address of the computer or device you use to view the website or open the e-mail, the URL page on which the web beacon is located, the type of web browser that was used to access the website, and previously set cookie values. Web beacons are sometimes used to collect advertising effectiveness data, such as counting page views, promotion views or advertising responses. Personal Information we receive from other sources/third parties

We obtain certain kinds of Personal Information about you from third parties. For example, we may collect usage data of your visits to our Site from the service providers that help us operate our Site or improve its functionality. We also collect information about you from data aggregation and data analytics services like Google Analytics. Information we disclose to third parties

We may disclose your Personal Information to third parties, our service providers, and our parent and affiliate companies. We may disclose your information to third parties as follows:

• We may disclose alumni names, contact information, images, videos and other Personal Information on or through the Site with your consent.
• We may disclose your information to third parties to maintain our business operations, including our Site, improve the quality of our Site, and protect our users and our network against fraud and security threats. We may disclose your information to our third-party service providers that facilitate the functions of our Site, such as our web hosting, video and cloud storage providers.  We may also provide your Personal Information and/or other information to service providers or contractors to perform functions on our behalf, including assisting us in communicating with you.

• Fulfillment Service Providers: We use certain fulfillment service providers, companies, individuals, and agents to facilitate and help us maintain our operations.  Such Fulfillment Service Providers perform tasks, services, or functions on our behalf, or assist us in analyzing how our services are used or delivered.  These Fulfillment Service Providers may include payment card processors, cloud-based storage and web-hosting providers, and other vendors that assist us in providing our services.  For example, if you view a video on our Site, you consent to your Personal Information being shared with the outside organization we use to enable videos on our Site. If you communicate by chat, you consent to your Personal Information being shared with the outside organization we use to enable chat communications on our Site. These Fulfillment Service Providers are granted access to your information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
• Newport Healthcare Affiliated Entities: We may disclose your information to other entities that make up the Newport Healthcare organization, or other companies within the Newport Healthcare family.
• Marketing Providers: We may provide information to third parties to assist us with our marketing and advertising efforts.
• Law Enforcement or Other Government Authority: We may from time to time be required to provide information to law enforcement or other governmental authorities pursuant to a warrant, court order, or other lawful process.

SMS and Text Information

Data obtained through our SMS program will not be shared with any third-parties for their own marketing reasons/purposes. Company may send you a text message via SMS or text when you opt-in or consent to receiving those messages. Such SMS or text messages may include marketing and other promotional messages. We may disclose your SMS or text message opt-in or consent data with our service providers that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages. If you would like to stop receiving text messages from Company at any time, please reply STOP or contact us at inquiries@newporthealthcare.com, with a subject line of “Privacy Policy.” After you send the message “STOP” to us, you will receive a message to confirm that you have been unsubscribed. We do not sell your Personal Information

We do not sell your Personal Information to third parties. Please note that “sale” of Personal Information does not include those instances when such information is part of a merger, acquisition, or other transaction involving all or part of our business.  If we sell all or part of our business, make a sale or transfer of assets, or are otherwise involved in a merger or other business transaction, we may transfer your Personal Information to a third party as part of that transaction.  If such transaction materially affects the manner in which your Personal Information is processed, we will notify you of such change prior to its implementation.

We share your Personal Information with third party advertisers for marketing purposes. We may disclose your email address to third parties who provide marketing services on our behalf to compile lookalike audiences for targeted advertising. The use of your email for this purpose will not result in your being sent advertisements by the third party.

How your information is stored, transferred, and secured

Company has reasonable security measures in place that seek to mitigate risk and uses reasonable, appropriate and customary procedures and technologies to help protect the confidentiality of any Personal Information collected through the Site. However, no website can be absolutely protected against intentional or malicious intrusion attempts despite our precautions. Furthermore, Company does not control the devices, computer or network through which you access the Site or over which you may choose to send Personal Information, and therefore cannot prevent potential interceptions or compromises to your information while in transit to the Site. The Site and/or any communications sent through or as a function of the Site may contain links to third-party websites. Please note that this Privacy Policy does not govern the practices of third parties, including our partners, third party service providers, and/or advertisers, even when those services are branded as, or provided on behalf of, Company.  Information collected from you by others, such as third-party websites that you access through links on this Site are governed by those entities’ privacy policies.  If you click a third-party link, you will be directed to that third party’s website. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over how these websites may collect your information and no liability for the practices, policies and security measures implemented on these websites.

Children’s Privacy

Company does not knowingly or intentionally collect Personal Information through the Site from children under thirteen (13) years of age. If you are under 13 years of age, do not attempt to register for or use any of our forms or other services on our Site, do not provide us any Personal Information about yourself unless you have the requisite parental consent. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact as described below. If we become aware that a minor has provided us Personal Information or otherwise used our Services in violation of the Policy, we will take steps to remove that information.

Depending on the individual circumstances, we collect and use Personal Information for the legitimate business purposes of Company. We use information from cookies and tracking technologies (e.g., pixels, web beacons) in order to improve and customize your browsing experience, for analytics and metrics about your visits to our Site (e.g. the information concerning the length of your visit to our Site, where your visit originated from) and for marketing our Products and Services to you. In the past twelve (12) months, depending on the individual circumstances, we have shared the categories of Personal Information collected in Categories [A-B, D-H] with the following categories of third parties: advertisers, social media providers and other third parties.

In the past twelve (12) months, depending on the individual circumstances, we have not disclosed the categories of Personal Information collected in Categories [A-H] with outside organizations or entities who are not service provider or contractors providing services on our behalf, except where required by law to do so.

Your rights regarding your Personal Information

• You have the right to request that the Company disclose the Personal Information that the Company collects, uses, shares and discloses about you. You may “request to know”: (i) the categories of Personal Information that the Company has collected about you; (ii) the categories of sources from which the Personal Information is collected; (iii) the business or commercial purpose for collecting or sharing your Personal Information; (iv) whether any categories of Personal Information were disclosed for a business purpose to third parties and the categories of third parties with whom the Company discloses your Personal Information; and (v) the specific pieces of Personal Information that the Company has collected about you. Your request may pertain to the Personal Information collected about you on or after January 1, 2022. If your request covers a time period beyond twelve [12] months from the date of your request, the Company may deny your request as to that time period where it would be impossible for the Company to provide you with the information or involve disproportionate effort. The Company may deny your request to search for certain information under certain circumstances (e.g., where the Company retains the information solely for legal and compliance purposes).
• You have the right under certain circumstances to receive specific pieces of your Personal Information in a format that is understandable, and to the extent technically feasible, in a structured, commonly used, machine readable format that allows you to transmit the information to another entity.
• You have the right to correct inaccurate Personal Information.
• You have the right to request deletion of Personal Information under certain circumstances. For example, we may not be required to delete Personal Information if we need to retain the information to complete the transaction for which the Personal Information was collected, perform on a contract with us, or to comply with a legal obligation. In addition, we may delay deletion with respect to data stored on an archived or backup system, until the archived or backup system relating to that data is restored to an active system or next accessed or used for a sale, disclosure, or commercial purpose.
• You have the right to know what information is shared with third parties, and to whom and to opt out of sharing for cross-context behavioral advertising. We do not sell your Personal Information.

This may involve, depending on the nature of the request, confirming that the email address provided corresponds with our records concerning the individual. Additional reasonable measures may also be required to verify the identity of the person making the request depending on the circumstances. For requests to delete made electronically, you may be required to submit the request to delete, and then separately confirm that you want your Personal Information deleted. We will maintain a record of your request to delete.
